Charges have formally been filed against the man arrested for possession of a firearm while he was on probation for charges related to a previous attempted-homicide case.

Cody Alan Butcher, 23, appeared in district court for the filing of charges Wednesday. He faces charges of possession of a weapon by a previous offender, a Class 5 felony; unlawfully carrying concealed weapon/knife, a Class 1 misdemeanor; violation of a protection order, a Class 1 misdemeanor; harassment, a Class 1 misdemeanor; and domestic violence.

According to a statement of probable cause penned by Cañon City Police Sgt. Billy Ray, officers were dispatched at about 5:20 p.m. June 22 to the Maverick Trailer Park in the 200 block of South Raynolds after a woman reported seeing a man cock a gun in the area and hearing a couple arguing. Officers discovered Butcher in the Vineyard Church parking lot north of the trailer park, matching the description given by the caller. Officers recovered a Smith & Wesson 9 mm handgun in the waistband of Butcher's pants. The gun had an inserted magazine, loaded with seven bullets with one inside the chamber.

Butcher told authorities he went to the trailer park to retrieve his 2-month-old child because he was upset that the baby's mother had brought him there.

"Cody said that the Maverick Trailer Park is a dangerous place and that he did not want his child there," the affidavit states. "Cody said that there are crazy things that happen there and the gun was only for protection."

Because Butcher is a convicted felon, he is prohibited from possessing a firearm. He was involved in a 2019 attempted murder case and sentenced in August 2020 to four years of supervised probation for his role in the assault of a man Nov. 4, 2019.

Judge reinstates probation for Cañon City man involved in attempted murder case

District Court Judge Lynette Wenner in September revoked Butcher's probation after he failed to comply with the conditions of his bond. She reinstated his probation in November, stating that she didn't want to send him to the Department of Corrections at that point because of his age. He could face a range of five to 16 years of DOC.

On June 23, Magistrate Meyrick set a $10,000 cash surety bond with conditions of no contact with the named victims and no firearm possession. Butcher will have a bond hearing July 6 and a preliminary hearing July 27.
